Why Wyoming

Several states have loosened the old limits on how long a trust may last, but many still limit it to one lifetime. Wyoming is among the most thoughtful of them, and it pairs long duration with other modern world-class trust features. Wyoming’s impeccable reputation as a haven for unregulated Private Family Trust Companies, its long history of defending privacy, and its pioneering digital asset laws has earned it the honorable title among many as “The Switzerland of the West.”

  • Lasts 1,000 years. Many states have rules against perpetuities. Under Wyoming Statute § 34-1-139(b), a trust that holds property in addition to direct interests in real estate may continue for up to 1,000 years if (1) the trustee maintains a place of business in Wyoming, administers the trust in Wyoming, or is a Wyoming resident, and (2) the trust terms require interests to vest or end within 1,000 years.
  • A perpetual Wyoming trustee that never changes or moves away. In the Dynasty Architecture, the family forms its own Wyoming Private Family Trust Company, set up to serve as the qualified Wyoming trustee. TSP's Private Family Trust Companies are unregulated Wyoming LLCs with an administrative nexus in Wyoming, and because the trustee is the company rather than any individual family member, it can serve in that role.   • A note on land. Real property held directly by a trust can still be subject to different states’ traditional rule against perpetuities. Families commonly address this by having the Private Legacy Trust layer which has its own private law with no rule against perpetuities own the real estate assets, and the Pass Through trust own the “other assets,” or have the Pass Through Trust set up an LLC that holds the real estate (like the PFTC), so the trust holds LLC membership interests (personal property) rather than the land itself.
  • Wealth preservation. Jurisdiction matters. Wyoming imposes no state income tax, including on trust income, capital gains tax, or inheritance tax on trust assets. If not structured in a world-class trust jurisdiction like Wyoming, your home state, may attempt to tax your trust or its beneficiaries depending on where people live and how the trust is structured.
  • Modern trust tools. Wyoming law recognizes spendthrift provisions (§ 4-10-502) and directed trusts (§ 4-10-718), which let a trust assign investment or distribution decisions to named advisors, useful for families who want to stay close to their own affairs.
  • Unmatched privacy laws. Wyoming does not require trusts to be publicly recorded, ensuring ultimate family privacy. For LLC’s, member owners are not made available to the public. “Quiet trust” provisions also empower trustees to keep beneficiary information sealed, not disclosing beneficial interests even to the beneficiaries themselves. This privacy adds layers of protection against outside “bad actors” and generational protection against “affluenza.”
